Terms and Conditions for Smooch Limited
Welcome to Smooch Limited, a dental hygiene and facial aesthetics practice in New Zealand that offers appointments through our online, phone and in person bookings systems and also via subscriptions. By using our website, booking an appointment, or subscribing to our services, you agree to be bound by these terms and conditions. Please read them carefully before proceeding.
1. Subscriptions
Smooch Limited provides various subscription options for dental hygiene and facial aesthetics services, as described on our website. You can choose the frequency and type of services that suit your needs and budget, and pay a fixed amount weekly or at another interval. As a subscriber, you will also receive a complimentary goodie bag when you sign up and at every visit, containing products to help you maintain your oral and facial health.
To subscribe, you need to fill out an online form with your personal and payment details, and select your preferred option. You will then receive a confirmation email with your subscription details and instructions on how to book your first appointment.
You can book your appointments online from the first availability, starting from June 2024. You can also reschedule or cancel your appointments online, subject to our cancellation policy (see section 4).
Your subscription will automatically renew at the end of each billing cycle, unless you cancel it before the next payment date. You can cancel your subscription at any time by logging into your account and following the instructions, or by contacting us at customerservice@smooch.co.nz or phoning us on 03 568 0542.
2. Dental fitness
Before subscribing to our services, you should ensure that you are dentally fit, meaning that you do not have any active dental problems that require treatment, such as tooth decay, gum disease, or infections. If you are not sure about your dental fitness, you should book a New Client appointment with us or consult your regular dentist.
If you subscribe to our services and we discover that you are not dentally fit during your first or subsequent visits, we may recommend additional treatments that are not covered by your subscription. You will be responsible for paying for these treatments separately, either at our practice or at another dental provider of your choice.
We reserve the right to refuse or terminate your subscription if we determine that you are not dentally fit or if you do not follow our advice on maintaining your oral health.
3. Facial aesthetics
Our facial aesthetics services include cosmetic injections, and dermal fillers. These services are performed by qualified and experienced practitioners who will assess your suitability and explain the risks and benefits before proceeding.
You must be over 18 years old to receive any of our facial aesthetics services. You must also inform us of any medical conditions, allergies, medications, or previous treatments that may affect your safety or results.
You should be aware that facial aesthetics services are not permanent and may require maintenance sessions to achieve or maintain the desired outcome. The results may vary depending on individual factors such as age, skin type, lifestyle, and expectations. We cannot guarantee a specific outcome or satisfaction with the results.
You should also follow the aftercare instructions provided by our practitioners to avoid complications and optimize the results. If you experience any adverse reactions or concerns after the treatment, you should contact us immediately for advice and assistance.
4. Cancellation policy
We understand that sometimes you may need to change or cancel your appointment due to unforeseen circumstances. However, we kindly ask that you give us at least 24 hours notice if you wish to do so, to allow us to offer your appointment to another client.
If you cancel or reschedule your appointment with less than 24 hours notice, or if you fail to attend your appointment without notifying us, we may charge you a cancellation fee of $50 NZD per service booked. This fee will be deducted from your subscription payment or charged to your credit card on file.
If you repeatedly cancel or miss your appointments without sufficient notice, we may suspend or terminate your subscription or refuse future appointments with you.
5. Liability
We take all reasonable care and precautions to provide high-quality and safe services to our clients. However, we are not liable for any injury, damage, loss, or claim that may arise from your use of our website, booking system, subscription services, dental hygiene services, facial aesthetics services, products, or advice.
You agree to indemnify us from any liability arising from your breach of these terms and conditions, negligence, misconduct, or violation of any law or regulation.
6. Privacy Policy
Confidentiality and the security of your personal information is something we take seriously. We will only use your information for the purposes of engaging with you, to provide guidance, advice or treatments. If you provide us with someone else's information, you must obtain the relevant authorisation to do so.
We try to be as paperless as possible with very little physical information held on-site at company offices. Our primary storage method is an Enterprise level IT system and therefore held electronically. Any physical information that you or your authorised agents (accountants, solicitors, insurers etc) might provide us is scanned in and then either returned to you or where appropriate, securely destroyed.
We will only share information when instructed to do so by you or any authorised agent. To illustrate, this typically occurs when we are referring you to one of our referral partners such as a dentist or specialist. It is worth knowing that we send the information to them, we do not use third parties nor do they have direct access into our systems.
It is also possible that our contracted locum service, IT providers (Zoho, Xero), compliance advisers and assessors or regulatory bodies such as the Dental Council or NZ Oral Health Association or an organisation purchasing Smooch Limited under strict non-disclosure agreements would need access to information for the purposes of running the business should a key person in the business be incapacitated or unavailable for either a short time or permanently, for assessing the business, maintaining IT systems and compliance with established regulation. Otherwise, access to your information is available only to staff of the firm and by you, where the Privacy Act 2020 gives you the right to request access to and correction of, your personal information.
As a final note, any advice provided as a result of our analysis can only be as good as the information received from you, so we ask that you provide us with the information we request. Without relevant and correct information about your personal medical situation, we run the risk of giving advice or treatment that are not appropriate to your needs. If you are unsure as to why we need certain information please ask so that we can explain.
7. Financial Information and payment defaults.
If you owe Smooch Dental Spa any money for the services you received, you agree to compensate Smooch Dental Spa for all the costs and disbursements incurred in recovering the debt. These costs may include but are not limited to, internal administration fees, legal costs on a solicitor and own client basis, Smooch Dental Spa collection agency costs, and bank dishonour fees. By accepting Smooch's services, you authorize Smooch Dental Spa or Smooch's agent to access, collect, retain, and use any financial information to assess your creditworthiness in the case of long-term finance payment plans. Additionally, you authorize Smooch to disclose your financial information to any other credit provider or reporting agency to provide or obtain a credit reference check, debt collection, or notify a default by you.
8. Changes
We may change these terms and conditions at any time without prior notice. The updated terms and conditions will be posted on our website and will apply to all current and future clients. You should check our website regularly to stay informed of any changes.
By continuing to use our website, booking system, subscription services, dental hygiene services, facial aesthetics services, products, or advice after the changes take effect, you agree to be bound by the updated terms and conditions.

9. Governing law
These terms and conditions are governed by and construed in accordance with the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the courts of New Zealand in relation to any dispute arising out of or in connection with these terms and conditions, our services, or our practice.
